THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of a "Todorovic Defense Emergency Motion for an Extension of Time to File Expert Witness Statements and Sentencing Memoranda" filed by the Defence for Stevan Todorovic on 17 April 2001 ("the Motion") and the Prosecutor’s Response filed by the Office of the Prosecution ("Prosecution") on 19 April 2001,

NOTING that the Defence seeks an extension of time of an additional ten days from 17 April 2001 to 27 April 2001 in which to file its expert witness statements and sentencing documents,

NOTING that the Prosecution raises no objection to the Motion but requests that, if the Motion is granted, the Prosecution be given time in which to comment upon the material and that the sentencing hearing scheduled for 4 May 2001 be maintained,

NOTING that, pursuant to the Order of the Trial Chamber of 26 February 2001, the expert reports were to be submitted by 3 April 2001.

NOTING the reasons stated by the Defence in support of the Motion,

CONSIDERING that it is in the interests of justice that the Trial Chamber be in possession of all factors that would assist it to evaluate the relevant sentence to be imposed on the accused,

PURSUANT TO Rule 127 of the Rules

HEREBY GRANTS the Motion and ORDERS as follows:

  1. the Defence expert medical reports and submissions on sentencing shall be filed no later than Friday 27 April 2001;
  2. at the same time the Defence shall indicate whether it intends to call any of the experts to testify in person;
  3. the Prosecution may respond to such reports and submissions either in advance in writing or orally at the sentencing hearing;
  4. if the Prosecution wishes to cross-examine any of the Defence expert witnesses it shall notify the Trial Chamber and the Defence no later than close of business on Tuesday 1 May 2001; and
  5. the sentencing hearing on Friday 4 May 2001 is hereby confirmed, commencing at 9.30 a.m.
