ORDER ASSIGNING A CASE TO A TRIAL CHAMBER

I, FAUSTO POCAR, Vice-President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the Indictment in The Prosecutor v Radivoje Miletic and Milan Gvero;

NOTING that the Registry has advised that the Accused, Radivoje Miletic, will be detained and transferred to the seat of the Tribunal pursuant to Rule 62 on 28 February 2005;

NOTING that Rule 62 requires that the President of the Tribunal forthwith assign the case to a Trial Chamber;

CONSIDERING the temporary absence of President Theodor Meron;

CONSIDERING that, pursuant to Rule 21 of the Rules of Procedure and Evidence of the International Tribunal, the Vice-President of the International Tribunal shall exercise the functions of the President during the latter’s absence;

HEREBY ASSIGN, effective on the date upon which Radivoje Miletic is transferred to the seat of the Tribunal, the present case to Trial Chamber II.
