I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

NOTING the Indictment in case The Prosecutor v. Zdravko Tolimir, Radivoje Miletic and Milan Gvero, as filed on 8 February 2005;

NOTING the Orders issued by the President of the Tribunal of 24 February 2005 and by the Vice-President of the Tribunal of 28 February 2005, assigning the case to Trial Chamber II;

NOTING that the initial appearance of the accused Radivoje Miletic and Milan Gvero pursuant to Rule 62(iii) of the Tribunal’s Rules of Evidence and Procedure ("Rules") took place before me on
2 March 2005;

NOTING Rule 65ter of the Rules which provides that the Presiding Judge of the Trial Chamber shall "designate from among its permanent members a Judge responsible for the pre-trial proceedings" ("pre-trial Judge");

NOTING Article 13quarter of the Statute of the Tribunal ("Statute"), enabling ad litem Judges of the Tribunal to adjudicate in pre-trial proceedings;

NOTING the powers of a pre-trial Judge as set out in Rule 65ter of the Rules;

PURSUANT TO Article 13quarter of the Statute and Rule 65ter of the Rules;

HEREBY DESIGNATE as follows:

1. The Trial Chamber seised of the case shall be composed of:

Judge Parker (Presiding)

Judge Thelin

Judge van den Wyngaert;

2. Judge van den Wyngaert shall be the pre-trial Judge pursuant to Rule 65ter of the Rules in this case.
