 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 9.01 a.m.

5             JUDGE FLUEGGE:  Good morning to everybody in the courtroom and to

6     those who are following our procedures, and I note that Mr. Dieckmann is

7     again with us to assist the witness.

8             If there is nothing to discuss at the outset, the witness should

 9     be brought in, please.

10                           [The witness takes the stand]

11             JUDGE FLUEGGE:  Good morning, Mr. Pecanac.  Welcome back to the

12     courtroom.  I have to remind you that the affirmation to tell the truth

13     you made at the beginning of your testimony last week still applies

14     today.

15             Mr. Vanderpuye is continuing his examination-in-chief.  You have

16     the floor.

17             MR. VANDERPUYE:  Thank you, Mr. President.  Good morning to you,

18     Your Honours, and everyone.

19                           WITNESS:  DRAGOMIR PECANAC [Resumed]

20                           [Witness answered through interpretation]

21                           Examination by Mr. Vanderpuye: [Continued]

22        Q.   Good morning, Mr. Pecanac.  We had 65 ter 7572, and I was showing

23     you some video footage.  We'll continue with that, please.  We were

24     18 minutes and two seconds in the video.  We can start from here.

25                           [Video-clip played]

Page 18179

1             THE INTERPRETER: "[Voiceover] We pass now Zepska.  Pardon me --"

2             THE WITNESS: [Interpretation] Excuse me, Your Honour.  I

 3     apologise.

4             JUDGE FLUEGGE:  We have to stop for a moment.  The interpreters

5     have a problem.  Please repeat.  What -- did you say something?  Yes.

6             THE WITNESS: [Interpretation] Your Honours, I'm sorry.  Yesterday

7     if I remember correctly, we were watching this footage in a private or

8     closed session, therefore I would kindly ask you that we continue in the

9     same manner today.  Thank you.

10             JUDGE FLUEGGE:  What is your position, Mr. Vanderpuye?

11             MR. VANDERPUYE:  Thank you, Mr. President.  With respect to the

12     particular segment of the footage, I don't think there is any -- I am not

13     going to ask any questions about it and there is no concern for this part

14     of it.  There is a following segment that I think would be more

15     appropriate to go into a private session to view.

16             JUDGE FLUEGGE:  Is this footage confidential?  I don't think so.

17             MR. VANDERPUYE:  No, it's not.  And the segment I am going to

18     play is, I think, about 40 seconds.

19             JUDGE FLUEGGE:  I think, Mr. Pecanac, to show this video can't be

20     a problem for you, but if you are then asked questions, then we come back

21     to this question.

22             Go ahead, please.

23             MR. VANDERPUYE:  Thank you, Mr. President.  We will start again

24     at 18 minutes --

25             THE WITNESS: [Interpretation] Thank you, Your Honour.

Page 18180

1             MR. VANDERPUYE:  Eighteen minutes and two seconds.

 2                           [Video-clip played]

3             THE INTERPRETER: "[Voiceover] We pass now Zepska -- pardon me,

4     Brloska Planina, and above is Radava, and Stublic and Kupusna to the

5     north.  This is Zepska mountain.  Here below in the village is the

6     village of Purtici.  This is the Borak Brdo village, and there is a peak

7     and another smaller summit.  The village over there is Godjenje.  The

8     road up there comes from Han Pijesak.  There is Crvena Zemlja, and that

9     up there, that bends the road towards the meadows is the village of

10     Stoborani."

11             MR. VANDERPUYE:  For the record we've stopped the video at

12     18 minutes, 43.1 seconds.  And now I will ask to go into private session,

13     Mr. President.

14             JUDGE FLUEGGE:  Private, please.

3             THE REGISTRAR:  We are back in open session, Your Honours.  Thank

 4     you.

5             JUDGE FLUEGGE:  Thank you very much.  I would like to discuss

6     with the Prosecutor whether it is necessary to have the notebook under

 7     seal.

8             Mr. Vanderpuye, what is your position?

9             MR. VANDERPUYE:  Mr. President, I don't have any problem with the

10     document -- with the notebook not being under seal.  I know, however,

11     though, that Mr. Pecanac has some concerns under Rule 90(e), and to that

12     extent, I expect that he will wish to have those under seal, to which I

13     have no objection.

14             If the problem is, I think -- are we in open session?

15             JUDGE FLUEGGE:  Yes.

16             MR. VANDERPUYE:  We need to go into private session, please,

17     Mr. President.

18             JUDGE FLUEGGE:  Private.

 6                           [Open session]

7             THE REGISTRAR:  We are back in open session, Your Honours.  Thank

 8     you.

9             JUDGE FLUEGGE:  Are there any other matters to discuss at this

10     stage?  I don't see that.  So, again, Mr. Pecanac, you want to raise

11     something?

12             THE WITNESS: [Interpretation] I am sorry, Your Honour.  Since I

13     am not a lawyer, but since this other notebook was going to be seized or

14     confiscated, it should be registered under a certain number to which I

15     may possibly refer in a possible future proceedings.  The first one is

16     Exhibit P20 something --

17             JUDGE FLUEGGE:  Mr. Pecanac, I have to interrupt you.  This is

18     not a problem at all.  If you refer to today's hearing, it is all what we

19     discussed on the record, and you will have the relevant references to

20     that notebook for sure.  It is in the custody of the Registry and we will

21     decide later about this document.

22             I think we are now at the end of your testimony.  You are free to

23     return to your normal activities.  The Chamber would like to thank you,

24     again, that you came here and provided us with your knowledge.

25             We adjourn and resume next Monday for the Pre-Defence Conference

Page 18255

 2                           [The witness withdrew]

 3                           --- Whereupon the hearing adjourned at 12.33 p.m.,

4                           to be reconvened on Monday, the 23rd day of

 5                           January, 2012, at 2.15 p.m.
