I, David Anthony Hunt, a judge of the International Criminal Tribunal for the Former Yugoslavia:

CONSIDERING the indictment against Zeljko RAZNJATOVIC ("the accused") confirmed by Judge Shahabuddeen on 30 September 1997 ("the indictment"), and the order of Judge Shahabuddeen of the same date which ordered the non-disclosure of the indictment;

CONSIDERING the Decision of Judge May dated 31 March 1999, which vacated in part the order for non-disclosure of the indictment and allowed the transmission to the Federal Republic of Yugoslavia of a copy of the arrest warrant and order for surrender of the accused, and allowed public disclosure of the fact that the accused is indicted before the International Tribunal;

AND CONSIDERING the Prosecution Motion to "Vacate Order of Non-Disclosure, dated 19 January 2001 and the Further Particulars Regarding Motion to Vacate Order on Non-Disclosure, of the same date;

BEING SATISFIED THAT existing circumstances no longer weigh in favour of non-disclosure of the indictment to the public, and that the interests of justice now weigh in favour of disclosure of the indictment to the public;

PURSUANT TO Rules 52 and 54

ORDER  

that the non-disclosure order of 30 September 1997 be vacated and that the indictment in case number IT-97-27-I, Prosecutor v. Zeljko RAZNJATOVIC (also known as "ARKAN") be made public.
