 5             THE REGISTRAR:  Good morning, Your Honours.  Good morning,

 6     everyone in and around the courtroom.  This is case IT-08-91-T, the

 7     Prosecutor versus Mico Stanisic and Stojan Zupljanin.

 8             JUDGE HALL:  Before we revert to closed session, the -- it would

 9     be recalled that yesterday we were canvassing the idea of how we would

10     work in an extra session today if needed.  Having regard to the estimates

11     that counsel, plural, have indicated, it may not be necessary; but if it

12     is, what we would do is rise at 1.30 instead of 1.45 and resume at 2.00.

13     And then today's sitting would end at 3.00.

21             THE REGISTRAR:  We're in open session, Your Honours.

22             JUDGE HALL:  There are -- there is a brief ruling that I have to

23     make and a housekeeping matter, not a ruling as such.  The ruling is that

24     in respect of the Prosecution's application as regards extended time for

25     Witness 176, who's scheduled to appear on Wednesday, for an additional

 1     time beyond the 20 minutes that is usually allotted to 92 ter witnesses,

 2     we have agreed that the Prosecution would be allowed an additional hour

 3     and a ten minutes, bringing the total time available for this witness an

 4     hour and 30 minutes when our written rulings for that would -- will

 5     follow.

 6             The second matter is that we would ask counsel to note in their

 7     diaries that Friday, the 4th of June, we have determined in this

 8     Trial Chamber is a non-sitting day.  So the parties would be able to use

 9     the time productively to prepare.

10             Yes, Ms. Korner, you have something to --

11             MS. KORNER:  I do, yes.  Your Honours, I was hoping to be able to

12     use the time firstly to hear what Your Honours wanted to raise with us

13     over adjudicated facts.  Secondly, Your Honours, to say that I was going

14     to raise with you --

15             MR. PANTELIC:  I do apologise.

16             Oh, I'm sorry, can we have an open curtain or --

17             MS. KORNER:  Yes.  I don't think there's anybody in the public

18     gallery.

19             MR. PANTELIC:  You never know.  You have to be ready for the

20     public.

21             MS. KORNER:  Your Honours, the first matter is, can I say, that I

22     was going to raise with you the question of the timing for Witness 176.

23     As a result of what you've heard over the last few days, it's absolutely

24     clear that every single adjudicated fact, bar two or three innocuous ones

25     in relation to the municipality of Teslic, is challenged.  I, therefore,

 1     have to spend more time with Witness 176 to deal with this.  The original

 2     application for time was based purely on the fact that I would be dealing

 3     with no more than the log-books, but I now have to go into matters, it's

 4     absolutely apparent, which I would otherwise not have gone into.  But can

 5     I leave that until perhaps nearer the time?

 6             JUDGE DELVOIE:  Ms. Korner, is it viva voce or 92 ter?

 7             MS. KORNER:  He's 92 ter, but perhaps I can deal with that -- I

 8     don't think that's -- I can deal with that at the time.

 9             Your Honours, the second matter is the question of adjudicated

10     facts which Your Honours indicated you wanted to discuss.  I don't know

11     whether you think there's enough time.

12             For the third matter, I'm afraid we'll have to go back into

13     private session just for a moment.

14             JUDGE HALL:  Well, the short answer about adjudicated facts is

15     that I don't think that the five minutes that we have would be sufficient

16     time to deal with that.  But we will go into private session for

17     Ms. Korner to deal with the third matter she wished to raise.
