 9             THE REGISTRAR:  Thank you.  Good morning, Your Honours.  This is

10     case number IT-08-91-A, the Prosecutor versus Mico Stanisic and

11     Stojan Zupljanin.

12             JUDGE AGIUS:  Thank you very much.

13             First of all, let me welcome everybody.  This is going to be the

14     last Status Conference, so we need to be a little bit more thorough than

15     usual.

16             Let me start with appearances, Prosecution first.

17             MS. BASSETT:  Marisa Bassett for the Prosecution, with

18     Laurel Baig and Case Manager Janet Stewart.

19             JUDGE AGIUS:  Thank you very much.

20             And Defence, appearances for Defence for Mr. Stanisic.

21             MR. BOURGON:  Good morning, Mr. President.  Appearing on behalf

 3             JUDGE AGIUS:  Thank you.  Next I want to make sure that both

 4     appellants can following the proceedings in a language that they can

 5     understand.

 6             I'll start with you, Mr. Stanisic.

 7             THE APPELLANT STANISIC: [Interpretation] I am receiving the

 8     interpretation and I understand the proceedings.  Thank you, Your Honour.

 9             JUDGE AGIUS:  Thank you, Mr. Stanisic.

10             Mr. Zupljanin.

11             THE APPELLANT ZUPLJANIN: [Interpretation] Good morning to

12     everyone.  I'm receiving the translation and I understand.  Thank you.

13             JUDGE AGIUS:  Thank you, that's good.

14             This Status Conference is called in accordance with Rule 65 bis

15     of the Rules of Procedure and Evidence of this Tribunal.  65 bis (B)

16     requires a Status Conference to be convened within 120 days after the

17     filing of a Notice of Appeal and, thereafter, within 120 days after the

18     last Status Conference.  This is to allow any person in custody pending

19     the appeal the opportunity to raise issues in relation thereto, including

20     the mental and physical condition of that person.

21             In the present case, the parties filed their notices of appeal on

22     the 13th of May, 2013, and the first Status Conference was held on

23     4th September, 2013.  The second to ninth Status Conferences were held on

24     11th of December, 9th April, 24th July, and 12th November, 9th March,

25     30th June, and 15th October of 2015, and 10th February 2016,

 1     respectively.  Today's Status Conference is the tenth in this case and

 2     was scheduled pursuant to an order issued on 21st April, 2016.

 3             I will now pass on to perhaps the most important part of today's

 4     Status Conference; namely, I would like to inquire into the status of the

 5     detention conditions and health situations of both Mr. Stanisic and

 6     Mr. Zupljanin.

 7             I'll start with you, Mr. Zupljanin.  If you have any concerns in

 8     relation to your condition of -- your detention or your state of

 9     health -- Mr. Stanisic, not Mr. Zupljanin.  Mr. Stanisic, sorry.

10             If you have any concerns in relation to conditions of your

11     detention or your state of health, I would invite you to raise them now.

12     And if you prefer, this discussion can take place in a private session.

13             THE APPELLANT STANISIC: [Interpretation] Your Honour, there's no

14     need for private session.  My health is normal.  Everything is regular.

15     I don't have any particular remarks to make.

16             JUDGE AGIUS:  I thank you, Mr. Stanisic.

17             Mr. Zupljanin, the same question.  And if you have any concerns

18     about the condition of your detention or your state of health and would

19     like to have these discussed in private session, please speak out and

20     we'll do that.

21             THE APPELLANT ZUPLJANIN: [Interpretation] There is no need for

22     that, Your Honour.  My state of health is usual.  It's true that the

23     length of time that we are spending here does have an effect on our

24     health, but so far everything is all right and thank you for hearing us

25     out today.

 1             JUDGE AGIUS:  Thank you, Mr. Zupljanin.

 2             At this point in the proceedings, I would usually outline the

 3     recent procedural history in this case; however, I note that there have

 4     been no publicly filed motions or decisions since the last Status

 5     Conference of 10th February 2016.  I will therefore move on to the final

 6     part of today's Status Conference, and that is issues that either of the

 7     parties would like to raise at this point.  Therefore, I will start with

 8     the Prosecution.

 9             Is there any issue that the Prosecution would like to raise?

10             MS. BASSETT:  No, Your Honour.  The Prosecution has nothing to

11     raise.  Thank you.

12             JUDGE AGIUS:  Thank you.

13             And counsel for Mr. Stanisic.

14             MR. BOURGON:  Thank you, Mr. President.  No issues to raise this

15     morning.  Thank you.

16             JUDGE AGIUS:  Thank you.  And similarly counsel for

17     Mr. Zupljanin.

18             MS. CMERIC:  Thank you, Mr. President.  Nothing at this point.

19             JUDGE AGIUS:  Thank you.

20             Now, are there any other further comments or questions that you

21     would like to make or put?

22             Yes, Mr. Bourgon.

23             MR. BOURGON:  Well, Mr. President, at the beginning of the Status

24     Conference, you announced that this would be the last Status Conference.

25     Of course, we understand this to mean that the judgement, final

 1     judgement, will be delivered in the next three months.  If there was any

 2     idea as to when the judgement will be delivered, that would be much

 3     appreciated on behalf of Mr. Stanisic.

 4             Thank you, Mr. President.

 5             JUDGE AGIUS:  Yes, and I think on behalf of everyone.

 6             I would like to inform you that my colleagues and I are in the

 7     process of finalizing our judgement in this case and we expect to deliver

 8     it at the end of June.  When I say "at the end of June," it is literally

 9     at the end of June.  A Scheduling Order to that effect will be issued

10     pretty soon; certainly within the next couple of weeks.

11             So I note that having just announced that the judgement will be

12     issued at the end of June, I confirm that this is the last Status

13     Conference in this case.  And therefore in addition to the usual thank

14     you to Prosecution and Defence for attending today's Status Conference, I

15     would also like to take this opportunity to thank everyone inside this

16     courtroom - stenographers, clerical staff, legal officers, interpreters,

17     whatever - as well as outside the courtroom for their co-operation and

18     assistance throughout these appeal proceedings, which have allowed for

19     this smooth running of this case.

20             There is no further business to transact, I understand, and that

21     means that this concludes this Status Conference, and I call these

22     proceedings to an end.
