The Appeals Chamber stated that Article 25 of the Statute did not provide the Defence with the right to appeal an acquittal but that the Prosecutor alone had that right.

The Appeals Chamber declared however that, if in her Appellant's brief the Prosecutor relies on a particular ground to reverse the acquittal, the Defence in its Respondent's Brief may seek to support the acquittal on additional grounds.
