Registry and Chambers:


Jim Landale, Spokesman for Registry
and Chambers, made the following statement:


Good afternoon,



You will have seen that the judgement
in the case against Sefer Halilovic was
rendered earlier today. Copies of that
judgement will be available in the course
of the day.



Yesterday, the Appeals Chamber issued
its decision on Gojko Jankovic’s
appeal against a ruling on 22 July this
year to refer his case to Bosnia and
Herzegovina pursuant to Rule 11 bis of
the Tribunal’s Rules of Procedure
and Evidence.



In its decision, the Appeals Chamber
allowed in part one ground of appeal, "insofar
as it objects to the Referral Bench’s
order instructing the Prosecutor


to continue her efforts in co-operation
with the OSCE or another international
organization to ensure the monitoring
and reporting on the proceedings of
this case before the State Court of
Bosnia and Herzegovina, and

to seek further direction from the
Referral Bench if arrangements for
monitoring and reporting should prove
ineffective."


The Appeals Chamber dismissed the remainder
of Jankovic’s grounds of appeal.
This means that arrangements will be
made for his transfer to Bosnia and Herzegovina
within 30 days. Copies of that decision
are online and available on request.



Furthermore, as you will have seen from
our press release this morning, Mladjo
Radic has been transferred to France
to serve his 20-year sentence, which
was upheld by the Appeals Chamber in
February of this year.



Tomorrow, a ceremony will be held in
Courtroom I starting at 9 a.m. in order
for the new permanent Judge of the ICTY,
Judge Moloto, to be sworn in, and for
Judge Christine Van den Wyngaert, formerly
an ad litem judge, to be welcomed
as a permanent judge. This is a public
event that you are all welcome to attend.



Folllowing this, there will then be
an extraordinary plenary session of the
permanent judges where the new President
and Vice President will be elected. We
will of course let you know the results
as soon as we have them.

Florence Hartmann, Spokesperson for
the Office of the Prosecutor, made the
following statement:



Regarding the judgment today related
to Sefer Halilovic, the OTP would like
to underline that even though the Court
was not satisfied that Halilovic had
control at the time and decided to acquit
him, the Chamber has established that
a number of inhabitants, innocent civilians,
of Uzdol and Grabovica were victims of
brutal murders committed by ABiH units.


Questions:


Asked whether the OTP would appeal
the Halilovic acquittal, Hartmann answered
that it was too early to say as the Prosecution
had to study the judgement before making
a decision.
