SCHEDULE:


As for the schedule, the Tribunal will be closed this Monday, 28 May for a UN holiday and the trials will resume on Tuesday, 29 May.



Yesterday, the Trial Chamber announced that trial for former Bosnian Army Commander Rasim Delić will begin on 9 July 2007 and a Pre-trial conference will be held on 2 July.



As Commander of the Main Staff of the Army of Bosnia-Herzegovina, Delić is charged with failing to take necessary and reasonable measures to punish the perpetrators who executed captured Bosnian Croats and surrendered HVO soldiers in villages of Maline and Bikoši in Travnik municipality in central Bosnia and Herzegovina. He is also charged with failing to take necessary and reasonable measures to prevent the torture, beatings, murder and decapitation of Bosnian Serb Army

soldiers committed by his subordinates in the Kamenica Camp. In addition, he is charged with not preventing the rape of three women also committed by his subordinates in the Kamenica Camp.



In a decision filed this morning, the Trial Chamber ordered that the Defence case in the Milutinović et al. case will begin on 6 August and the Pre-Defence conference is scheduled for 22 June.


Tomorrow, a Pre-Defence conference will be held in the Dragomir Milošević case at 14:15 in courtroom I. Following the conference, the Defence will give its opening statement and the present its first witness.


The trials for Popović et al. and Prlić et al. will sit tomorrow only. The trials will resume their normal schedule next week.


Finally, the Haradinaj et al. and Boškoski and Tarčulovski trials will continue this week and next.


Today’s Filings


In the Milutinović et al. case, the Trial Chamber filed an order today directing the Prosecution to initiate contempt proceedings regarding the witness Lakić Đorović. According to a Prosecution motion on the matter, following Đorović’s return to Serbia after testifying before the Tribunal, the witness was arrested and threatened with physical violence losing his military post.

Olga Kavran, Spokesperson for the Office of the Prosecutor, made the following statement:


In early June, ICTY Chief Prosecutor Carla Del Ponte is planning to conduct an official working visit to Belgrade, Serbia. The purpose of this visit is to meet with various officials, both at the political and the operational level, who are involved in the issues of cooperation with the Tribunal.



The Prosecutor is ready to work with the new government on their efforts to achieve full cooperation with the ICTY, which means the arrest and transfer to the Tribunal of Ratko Mladić, Radovan Karadžić and the remaining fugitives. She welcomes the declared readiness of the newly elected government to do everything in its power to fulfil its international obligations so that Serbia can move forward. Since cooperation between Serbia and the Tribunal has been virtually at a standstill for over a year now, the Prosecutor hopes that the meetings she will hold in Belgrade will be fruitful.


Questions:


Asked if there was a reaction from Belgrade regarding the Prosecutor’s visit in early June, Kavran said that she would not comment on their behalf and suggested that the journalist refer the question to Belgrade. Kavran added that the Prosecutor has expressed her readiness to work with the new government and that in order for any movement forward, Belgrade would have to be ready to work with the Tribunal.


Asked what the next procedural step would be in the contempt proceedings for the Milutinovic et al. case, Hodžić said that Trial Chamber has now asked the Prosecution to instigate the proceedings and the next step would be to investigate the allegations. If there was sufficient evidence, then the prosecution would issue an indictment for contempt.


Kavran added that these proceedings stem from a detailed motion filed by the Prosecution a few weeks ago informing the Trial Chamber of these allegations of witness intimidation.
