Date: 17.01.2007

Time: 12:00

Registry and Chambers:

Refik Hodžić, Spokesman for Registry and Chambers, made the following statement:

In the Zelenović case, the Prosecution and Defence filed on 14 December 2006 a confidential joint motion for consideration of a plea agreement. The confidentiality was lifted yesterday in a motion hearing. The hearing continued this morning and Zelenović pleaded guilty to all seven counts as agreed upon in the joint submission, three counts involving torture and four counts involving rape. The Prosecution recommended that the Trial Chamber impose a prison term within the range of 10 to 15 years and the Defence recommended a term of seven to 10 years.

When Zelenović receives his sentence, the so called "Foča rape case" will be concluded before the Tribunal. The initial indictment charged eight persons for crimes against humanity, grave breaches of Geneva Conventions and violations of laws and customs of war in relation a to a campaign of systematic rape of Bosnian Muslim women in the eastern Bosnian town of Foča. In February 2001, Dragoljub Kunarac, Zoran Vuković and Radomir Kovač were convicted in a landmark judgement for rape as crime against humanity. In September and December 2005, Radovan Stanković and Gojko Janković were transferred to Bosnia. Radovan Stanković was sentenced to 16 years’ imprisonment by the Trial Chamber of the Court of Bosnia and Herzegovina and Gojko Janković is currently on trial. Dragan Gagović and Janko Janjić died during arrest attempts.

SCHEDULE:

Apart from the ongoing trials, Milutinovć et al, Prlić et al, Popović et al and Milosević will all continue sitting this and next week. A status conference is scheduled for tomorrow afternoon in the Mićo Stanišić case. The Mrkšić et al. case rebuttal hearings which were scheduled for this week have been postponed due to witness unavailability.

FILINGS:

On Friday 12 January, The Trial Chamber filed its decision granting the prosecutions motion to amend the amended indictment in the Haradinaj et al case. Also in the case, orders were filed reassigning the case to Trial Chamber I, appointing ad-litem Judges Höpfel and Støle to the case and appointing Judge Orie as pre-trial Judge.

OUTREACH:

I am very pleased to announce that the ICTY web unit has refreshed and redesigned the Albanian ICTY website and launched these changes earlier this week. The website now includes many of the features found on the English, French and BCS websites – the key figures, ICTY cases and judgements for those cases which deal with Kosovo, Basic Legal Documents, information about the ICTY, latest developments, ICTY at a Glance and a page on the ICTY Detention Unit with photos and the English language video. The launch of the website is the result of a lot of hard work by our web unit and the Priština field office and means that information about the ICTY can now be found in all five languages relevant to the Tribunal’s work. I encourage all media interested in Kosovo-related cases to take a look and use the Albanian website as an additional source of information.

Office of the Prosecutor:

Olga Kavran, Spokesperson for the Office of the Prosecutor, made no statement.

Questions:

Asked if there were any further developments in the Šešelj case, Hodžić said that nothing has changed and that his health condition was normal.

Asked if Judge Orie would be taken off the Šešelj case since he was now appointed as pre-trial Judge in the Haradinaj et al. case, Hodžić said that he could not comment on scheduling issues until an order was filed. Hodžić added that decisions on assignment of cases would be made with the aim of making the most effective use of judges and courtroom space.

Asked if the Tribunal’s website in Bosnian/Croatian/Serbian would be updated, Hodžić said that it was updated daily and to expect a complete overhaul of the Tribunal’s website for all five languages in the coming months. This redesigned site would be slightly different in form and updated simultaneously in English, French, Bosnian, Croatian, Serbian, Macedonian and Albanian.
