Liam McDowall, Senior Policy Advisor to the Registry, made the following statement:
SCHEDULE:
Next week, the trials for Popović et al., Prlić et al., Delić and Milutinović et al. will continue. Also next week, an appeals hearing will be held in the Hadzihasanović and Kubura case on 4 and 5 December in courtroom I.
The courtrooms will be busy before the winter recess with various hearings in December:; contempt proceedings for Dragan Jokić on 10 December; the Šeselj case will reconvene on 11 December; a status conference for Lukić and Lukić on 10 December and a status conference for Zdravko Tolimir on 11 December.
Office of the Prosecutor:
Olga Kavran, Spokesperson for the Office of the Prosecutor, made no statement.
Questions:
Asked about the news that Miroslav Radić has been indicted in Croatia, Kavran answered that she had no comment. She was asked whether this could be double jeopardy and responded that that would only be the case if he were charged with the same crimes as those for which he stood trial at the ICTY. As she had no yet seen indictment, she could not comment on whether this was double jeopardy. She added that reports in the media seem to suggest that Radić is being charged with crimes which are different to those for which he stood trial at the Tribunal.
In answer to a question regarding any co-operation the Tribunal was giving to prosecutors in Croatia, Kavran stated that there was on-going co-operation with the prosecutor’s office in Croatia. There had been numerous requests for assistance to which the OTP had responded.
Asked whether this was the first time someone acquitted by the ICTY had been re-indicted for other crimes, Kavran stated that she believed it was but that she would have to double check.
Asked to comment on rumours that the Deputy Prosecutor was leaving, Kavran answered that he had not made any announcement to that effect.
A journalist asked whether the Haradinaj et al case had now closed to which Kavran responded that the prosecution case had not yet closed. There were still a number of decisions pending before the Trial Chamber regarding evidentiary issues. She could not specify on the particular issues. McDowall added that during the last sitting in Haradinaj, the Trial Chamber made an oral ruling that there would be no more prosecution witnesses.
In answer to a question on the length of sentence requested by the prosecution in its closing arguments in the Haradinaj et al case, Kavran pointed out that the prosecution had not yet presented its closing arguments as the defence had yet to present its case. McDowall added that closing arguments had not yet been scheduled. Procedurally they would take place after the defence case-in-chief.
Asked to confirm that the Prosecutor would be in Belgrade on 3 December as reported in Belgrade media, Kavran stated that this was indeed the case. She added that announcements of this nature were usually only made once all the meetings had been scheduled. It would be a one day visit.
