DECISION TO VACATE THE ORDER FOR NON-DISCLOSURE ENTERED 8 JUNE 2001

I, Judge Fouad Riad, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

PURSUANT to Rules 53 and 54 of the Rules of Procedure and Evidence of the Tribunal ("the Rules");

CONSIDERING the Review of the Indictment of 8 June 2001;

CONSIDERING the Order on Review of the Indictment Pursuant to Article 19 of the Statute, which ordered the non-disclosure of the indictment IT-01-46-I;

CONSIDERING the Motion of the Prosecutor to Vacate in full the Order for Non-Disclosure Entered on 8 June 2001, filed on 24 July 2001 ("Motion of the Prosecutor");

CONSIDERING that a significant ground for the initial order of non-disclosure no longer exists for reasons provided in the Motion of the Prosecutor;

HEREBY ORDER that the non-disclosure order of 8 June 2001 shall be vacated in full, effective on the date and time of arrival of the accused, Rahim ADEMI, on the territory of the Kingdom of the Netherlands.
