I, Carmel Agius, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):

PROPRIO MOTU;

NOTING the confidential and ex parte "Decision on "Motion of the Prosecutor to Schedule a Fitness Hearing and to Take Related Measures"" ("Decision") and confidential "Order for Service of Indictment" ("Order"), both issued by me on 19 March 2003;

CONSIDERING that the matter was being dealt with confidentially only in so far that it related to the details of health of the Accused Janko Bobetko ("Accused");

CONSIDERING that the Decision and Order do not detail the health concerns of the Accused and that therefore there is no need for them to remain confidential;

CONSIDERING that, consistent with Article 21 of the Statute of this Tribunal and pursuant to Rule 54 of the Rules of Procedure and Evidence, it is in the interest of justice to lift the confidentiality of the Decision and Order;

CONSIDERING FURTHER that lifting the confidentiality of the Decision implies that the ex parte status of the Decision is lifted simultaneously;

HEREBY LIFT the confidentiality of the Decision and Order filed on 19 March 2003.
