I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
NOTING the "Intent to File Notice of Appeal and Request for Extension of Time to File Notice of Appeal,” filed by Radoslav Brdjanin on 22 September 2004;
NOTING my Order Assigning Judges to a Case Before the Appeals Chamber, issued 28 September 2004;
NOTING my Order appointing myself as Pre-Appeal Judge, issued 4 October 2004;
CONSIDERING that Rule 65 ter of the Rules of Procedure and Evidence ("Rules"), read together with Rule 107 of the Rules, authorizes the Presiding Judge of the Appeals Chamber to designate a member of the Appeals Chamber to be responsible for pre-appeal proceedings ("Pre-Appeal Judge");
CONSIDERING the need to ensure expeditious proceedings in this matter;
HEREBY DESIGNATE, with immediate effect, Judge Mohamed Shahabuddeen as Pre-Appeal Judge.
