TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):

BEING SEISED OF the "Prosecution’s Request for Variation of Page Limit" ("Request"), filed on 4 September 2003, in which the Prosecution requests authorisation to exceed the page limit for its Response to the Defence "Motion for Judgement of Acquittal – Rule 98 bis" and to file up to 180 pages;

CONSIDERING that the 150 page length indicated orally was intended as a guideline only;

CONSIDERING that no prejudice will be caused to the Accused Radoslav Brdjanin;

FOR THE FOREGOING REASONS

PURSUANT TO Article 54 of the Rules of Procedure and Evidence;

HEREBY GRANTS leave to the Prosecution to exceed the page limit in its Response.
