I, Judge David Hunt, as Pre-Trial Judge and under Rule 65ter of the Rules of Procedure and Evidence of the International Criminal Tribunal for the Former Yugoslavia ("International Tribunal"),

NOTING that Counsel for Momir Talic (“the accused”) have filed their Motions in the French language, as they are entitled to do under the provisions of the International Tribunal’s Statute;

NOTING that the Conference & Language Services Section of the International Tribunal has indicated to the Trial Chamber that, due to lack of personnel, it will not be in a position to translate substantial filings in the French language into the English language without the risk of more than negligible delays, whereas it does not have the same difficulties in relation to translating documents filed in the English language into the French language,

NOTING FURTHER that the Order for Filing of Motions made on 31 August 1999 ("Order for Filing of Motions") directs the respondent to a Motion to file a response within fourteen calendar days from the filing of the Motion,

AND CONSIDERING that it would be unfair to the Prosecutor if the time limits provided for under the Rules of Procedure and Evidence or in the Order for Filing Motions for responding or replying to documents filed on behalf of the accused were to run from the date of the filing of the French original,

HEREBY ORDER that the time limits set under the Rules of Procedure and Evidence and in the Order for Filing of Motions for the Prosecutor’s response or reply to documents filed by Counsel for the accused in the French language shall not commence to run until the receipt by the Prosecutor of a translation of that document into the English language.
