Trial Chamber I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

Noting the "Prosecutor’s Request for an Order issuing a Schedule for Defence filing of a Rule 67 Notice of Alibi or Special Defences" ("Request") filed on 22 February 2005, whereby the Prosecution requests that the Chamber issue an order requiring the Defence of Beqa Beqaj ("Defence") to file any notices under Rule 67 of the Rules of Procedure and Evidence ("Rules") at least two weeks prior to the trial;

Noting that the Defence has not filed a response to the Request;

Noting that in its Pre-trial Brief Pursuant to Rule 65ter (E) filed confidentially on 22 February 2005 the Defence submits that Beqa Beqaj was never present at the incident that allegedly occurred on 11 June 11 2004;1

Hereby Orders the Defence to notify its intent to offer the defence of alibi, if any, pursuant to Rule 67(A)(i)(a) of the Rules no later than 8 April 2005.
