I, FAUSTO POCAR, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
NOTING the "Interlocutory Appeal of the Accused Josip Jovic Pusuant to Rule 72(B)(i) of the Rules of Procedure and Evidence", filed on 5 January 2006 by Counsel for Josip Jovic against the "Decision to Deny the Accused Josip Jovic’s Preliminary Motion to Dismiss the Indictment on the Grounds of Lack of Jurisdiction and Defects in the Form of the Indictment", rendered by the Trial Chamber on 21 December 2005;
CONSIDERING Articles 12(3) and 14(3) of the Statute of the International Tribunal and Rule 72(B)(i) of the Rules of Procedure and Evidence;
CONSIDERING the composition of the Appeals Chamber of the International Tribunal as set out in document IT/242 issued on 17 November 2005;
CONSIDERING that pursuant to Article 14(2) of the Statute of the International Tribunal, I am the Presiding Judge on all appeals cases on which I sit;
HEREBY ORDER that the Bench in Prosecutor v. Josip Jovic, Case No. IT-95-14 & 14/2 – R77– AR.72.1 shall be composed as follows:
