Mr. Mark Harmon
Counsel for the Accused:
Mr. Slobodan Cvijetic
Mr. Slobodan Zecevic
I, FLORENCE NDEPELE MWACHANDE MUMBA, pre-sentencing Judge in this case,
BEING SEISED OF the "Prosecution’s Motion for a Variation From Page Limits in Respect of its Filing Pursuant to Order on Production of Additional Evidence Pursuant to Rule 98", filed confidentially on 5 January 2004 ("Motion"), which seeks an extension of 5 (five) pages of the 10 (ten) page limit for motions set by the Practice Direction on the Length of Briefs and Motions, IT/184 Rev. 1, 5 March 2002 ("Practice Direction"),
NOTING that pursuant to paragraph 7 of the Practice Direction the page limits may be exceeded if authorization is sought in advance from the Chamber and if "an explanation of the exceptional circumstances that necessitate the oversized filing" is provided,
CONSIDERING that the Trial Chamber ordered the Prosecution on 5 December 2003 in the "Order on Production of Additional Evidence Pursuant to Rule 98" to produce additional evidence in the form of a detailed description and assessment of the co-operation by Miroslav Deronjic,
FINDING that the requirements of paragraph 7 of the Practice Direction have been met and that the variation sought in the Motion is warranted in this case,
FOR THE FOREGOING REASONS,
HEREBY GRANT the Motion.
Done in English and French, the English version being authoritative.
Dated this thirteenth day of January 2004,
At The Hague
The Netherlands
