THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal");

BEING SEISED of the confidential Defence motion to compel production of certain documents by the Office of the Prosecutor ("Prosecution") dated 11 February 1998 ("Motion");

CONSIDERING the Prosecution’s Response to the Motion of 23 February 1998;

CONSIDERING the Trial Chamber’s need to adequately consider the documents the subject of the Motion;

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence;


  1. The Prosecution shall disclose to the Trial Chamber the subject material of the Motion by 10 a.m. on Friday 6 March 1998, namely the witness statement in support of the indictment of the accused Anto Furundzija dated 2 November 1995 ("indictment").
  2. The aforementioned disclosure to the Trial Chamber shall be confidential.
  3. The Prosecution shall disclose to the Trial Chamber by 10 a.m. on Friday 6 March 1998 the statements of Witness A in support of the indictment which have been disclosed to the Defence.
  4. The material referred to in paragraphs 1) and 3) is to be submitted purely to assist the Trial Chamber in its consideration of the Motion, and will not be used as evidence unless and until it is admitted in the course of the Trial.
