 2                           [Open session]

 3                           --- Upon commencing at 2.17 p.m.

 4                           [The accused entered court]

5             JUDGE ANTONETTI: [Interpretation] Mr. Registrar, will you please

 6     call the case.

7             THE REGISTRAR: Your Honours, case number IT-01-47-T, the

8     Prosecutor versus Enver Hadzihasanovic and Amir Kubura.

9             JUDGE ANTONETTI: [Interpretation] Thank you, Mr. Registrar.

10             The appearances for the Prosecution, please.

11             MR. WITHOPF:  Good afternoon, Mr. President.  Good afternoon,

12     Your Honours.  Good afternoon, Counsel.  For the Prosecution, Tecla

13     Benjamin, Ekkehard Withopf, and Ruth Carver, the case manager.

14             JUDGE ANTONETTI: [Interpretation] Thank you, Mr. Withopf.

15             The appearances for the Defence, please.

16             MS. RESIDOVIC: [Interpretation] Good afternoon, Your Honours.  On

17     behalf of General Hadzihasanovic, Edina Residovic, lead counsel; and

18     Alexis Demirdjian, legal assistant.  Thank you.

19             JUDGE ANTONETTI: [Interpretation] Thank you.

20             And the other Defence team.

21             MR. IBRISIMOVIC: [Interpretation] Good afternoon, Your Honours.

22     On behalf of Mr. Kubura, Rodney Dixon, Fahrudin Ibrisimovic, and Nermin

23     Mulalic, legal assistant.

24             JUDGE ANTONETTI: [Interpretation] Thank you.  The Chamber bids

25     good afternoon to all those present after the weekend.  They also greet

Page 5249

1     the representatives of the Prosecution, the Defence counsels, the

2     accused, as well as all the staff of this courtroom, and the interpreters

 3     in particular.

4             We have a witness today who is planned to take two days.  The

5     Prosecution has supplied an amended plan for this week and the week that

6     follows.  Regarding next week, we have envisaged Thursday, the 8th of

7     April a hearing devoted to the admission of documents.  Should the

8     witness planned for Tuesday and Wednesday finish earlier, in that case we

9     can address the admission of documents earlier.  In that case, we can do

10     it Wednesday rather than Thursday.  But all that will depend on the way

11     in which we observe the planning and the requirements of the hearings.

12             We will now go into private session.  So, Mr. Registrar, let us

13     go into private session.

 7                           [Open session]

8             THE REGISTRAR:  Your Honours, we are in open session.

9             JUDGE ANTONETTI: [Interpretation] I shall now give the floor to

10     Mr. Withopf for the planning for tomorrow, as we are about to adjourn and

11     we have finished with the witness.

12             You have the floor, Mr. Withopf.

13             MR. WITHOPF:  Mr. President, Your Honours, for the reasons as

14     explained on Friday, tomorrow there will, unfortunately, be no witness

15     available.  There will be two witnesses, however, on Wednesday.  One of

16     them is likely to carry on on Thursday, and we will have another witness

17     scheduled for Friday.

18             I thought that tomorrow morning, however, can be used for this

19     informal meeting involving representatives of the Prosecution, Defence

20     counsel, the Chamber's legal officer, and the registrar in order to

21     discuss the issue of tendering the documents later on.

22             JUDGE ANTONETTI: [Interpretation] I thought that the informal

23     meeting would be held only between the parties, the registry, and the

24     legal officer of the Chamber, without the Judges.

25             MR. WITHOPF:  That's right.

Page 5325

1             JUDGE ANTONETTI: [Interpretation] Because the interpreters added

2     us.  The interpreters seem to believe that we should be present -- no,

 3     without the Judges.

4             MR. WITHOPF:  That's exactly correct, Mr. President.  It's meant

5     to be without the Judges.

6             JUDGE ANTONETTI: [Interpretation] Very well.  So there will be no

7     hearing tomorrow.  There will be this meeting, informally, and we will

8     resume the proceedings on Wednesday at 9.00, because we're working in the

9     mornings Wednesday, Thursday, Friday.  And then next Monday it will be in

10     the afternoon and then again Tuesday, Wednesday, Thursday of the

11     following week.

12             Have you had time to go and see the models, Mr. Withopf?  When I

13     see this empty space in front of us, I thought that perhaps it could be

14     occupied by the model.

15             MR. WITHOPF:  Mr. President, Your Honours, I'm as curious as you

16     obviously are to see the model, but you should ask the question to my

17     learned friends from the Defence side.  I'm basically always available to

18     see the model, and I'm looking forward to seeing it.  So my friends from

19     the Defence side are far better in a position to answer this question

20     than I.

21             JUDGE ANTONETTI: [Interpretation] Madam Residovic.

22             MS. RESIDOVIC: [Interpretation] Mr. President, since my learned

23     friend is impatient, before this hearing I suggest that it be on

24     Wednesday, as we will have a witness who can view this model.  And after

25     that, we will be having two international witnesses, who will also be

Page 5326

1     able to use the model.  And we'll be working all three days in this

2     courtroom, so I think that that would be the most appropriate way to

3     finally set up the model.  Thank you.

4             JUDGE ANTONETTI: [Microphone not activated]

5             THE INTERPRETER:  Microphone, Your Honour.  Microphone, Your

 6     Honour, please.

7             JUDGE ANTONETTI: [Interpretation] I was just asking whether there

8     were any other questions.  If not, the hearing is adjourned.  And please

9     be back here on Wednesday at 9.00 a.m.

10                           --- Whereupon the hearing adjourned at 6.34 p.m.,

11                           to be reconvened on Wednesday, the 31st day of

12                           March, 2004, at 9.00 a.m.
