I, O-GON KWON, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this case by virtue of the Order of Trial Chamber III dated 10 December 2001,

NOTING that, at the Status Conference of 12 April 2002, during which the accused Sefer Halilovic ("Accused") was represented by Mr. Faruk Balijagic, the Defence was ordered to file a defence pre-trial brief three months from the filing date of the Prosecution pre-trial brief, and that the date for filing the defence pre-trial brief expired on 17 September 2002,

NOTING that, by his Decision dated 19 June 2002, the Registrar withdrew the assignment of Mr. Faruk Balijagic as defence counsel for the Accused and assigned Mr. Richard Soyer,

NOTING the motion filed by Mr. Richard Soyer on 17 September 2002 requesting an extension of time for the filing of the defence pre-trial brief due to the difficulties experienced in obtaining instructions from the Accused,

NOTING the response of the Prosecution filed 24 September 2002, in which the Prosecution does not oppose the request for an extension of time and requests that the Trial Chamber order the Accused to attend at the next Status Conference,

NOTING the Decision of the Deputy Registrar dated 25 September 2002 withdrawing the assignment of Mr. Richard Soyer as defence counsel for the Accused and assigning Mr. Bakir Caglar as defence counsel,

NOTING the Scheduling Order of 24 July 2002 postponing the Status Conference to a time and date to be fixed,

CONSIDERING that, as a result of the changes in the representation of the Accused, there has been a substantial delay in the preparation of this case for trial and steps need to be taken to advance the preparation of the case towards trial-readiness,

CONSIDERING HOWEVER that, in the circumstances, it is appropriate to extend the time-limit for the filing of the defence pre-trial brief, permitting Mr. Bakir Caglar sufficient time to familiarise himself with the case and take instructions from the Accused,

CONSIDERING that, as the Accused is represented by defence counsel, and with whom the Accused is expected to cooperate fully, there is no need for him to attend at the Status Conference,

PURSUANT to Rules 54 and 65 ter (B) of the Rules,

HEREBY ORDER that

  1. the defence pre-trial brief shall be filed by the Defence on or before Monday, 23 December 2002; and
  2. a Status Conference be scheduled for 3 p.m. on Tuesday, 29 October 2002.
