THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
BEING SEISED of a "Motion for an Extension of Time" filed by the Defence of Sefer Halilović on 6 October 2004 ("Motion"), requesting a five day extension of time to file its response to the "Prosecutor’s Motion Seeking Leave to Amend the Indictment" filed by the Office of the Prosecutor ("Prosecution") on 29 September 2004,
NOTING that a response to a motion is to be filed within fourteen day of the filing of the motion pursuant to Rule 126 bis of the Rules of Procedure and Evidence of the International Tribunal ("Rules"),
NOTING that a Trial Chamber may, on good cause being shown, enlarge any time prescribed under the Rules pursuant to Rule 127 of the Rules,
NOTING that the Prosecution and Defence were ordered to file their final pre-trial briefs in this matter no later than 13 October 2004 and 1 November 2004, respectively, or to indicate by those dates that the pre-trial briefs, as previously filed, shall stand as their final pre-trial briefs,1
CONSIDERING that a review of the Prosecution pre-trial brief by the Defence would assist the Defence to properly respond to the motion seeking leave to amend the indictment,
CONSIDERING that there is good cause for allowing the extension of time,
PURSUANT TO Rules 54,126 bis and 127 of the Rules,
HEREBY GRANTS the Motion and ORDERS the Defence to file its response no later than Monday, 18 October 2004.
