DECISION ON RAMUSH HARADINAJ’S MOTION FOR PROVISIONAL RELEASE

I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal") in the case of the Prosecutor v. Ramush Haradinaj, Idriz Balaj and Lahi Brahimaj;

NOTING the "Decision on Ramush Haradinaj’s Motion for Provisional Release", filed on 6 June 2005;

NOTING that there is a clerical error in paragraph 50 of the said Decision;

NOTING that paragraph 50 now reads: "In light of the foregoing, the Trial Chamber is also satisfied that there is no evidence that, if released, the Accused will not pose a danger to any victim, witness or other person";

CONSIDERING that paragraph 50 should read: "In light of the foregoing, the Trial Chamber is also satisfied that there is no evidence that, if released, the Accused will pose a danger to any victim, witness or other person";

PURSUANT to Rule 54 of the Tribunal’s Rules of Procedure and Evidence;

HEREBY ORDERS that the Decision shall be amended to read as set out above.
