THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
BEING SEISED of "Accused Mario Cerkez’s Additional Documents to be Entered into Evidence" and "Accused Mario Cerkez’s Rejoinder ("Zagreb materials") Documents to be Entered into Evidence" filed by counsel for Mario Cerkez ("the Defence") on 27 and 28 November 2000 respectively (together "the Application")
BEING SEISED of an oral request from the Office of the Prosecutor ("Prosecution") to admit one additional document as being part of a series of documents for which admission was sought by the Defence,
HAVING HEARD the arguments of the parties in open session on 5 December 2000 and
NOTING that a number of the documents have already been admitted as exhibits in this case, as identified in Annex 1 hereto,
HAVING RENDERED its Decision on the Application orally on 8 December 2000,
PURSUANT TO Rule 89 of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY CONFIRMS ITS DECISION GRANTING THE APPLICATION IN PART and admits the documents identified in Annex 2 attached hereto.
