THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of "The Accused Mario Cerkez’s Application for Extension of Time Within Which the Accused Mario Cerkez’s Motion to Dismiss Some Counts of the Indictment should be Filed", filed on behalf of the accused Mario Cerkez on 13 March 2000 ("the Application"), requesting an extension of time in which to file a motion pursuant to Rule 98 bis of the Rules of Procedure and Evidence of the International Tribunal ("the Rules") from Friday 17 March 2000 to Thursday 23 March 2000,

NOTING the Pre-Defence Conference held on 16 February 2000 pursuant to Rule 73 ter of the Rules,

NOTING the Scheduling Order issued by the Trial Chamber on 23 February 2000 fixing the date for submission of any such motion in accordance with Rule 98 bis; setting the date for filing of any response by the Office of the Prosecutor ("Prosecution"); and fixing the date of 30 March 2000 for oral argument on such motion,

CONSIDERING that the Defence case is scheduled to commence on Monday 10 April 2000,

CONSIDERING that all parties have been informed of the proposed timetable in this matter throughout,

HEREBY DENIES the Application and confirms the schedule set forth in the Scheduling Order of 23 February 2000.
