DECISION

THE REGISTRAR,

CONSIDERING the Statute of the Tribunal as adopted by the Security Council under Resolution 827 (1993), and in particular Article 21 thereof;

CONSIDERING the Rules of Procedure and Evidence as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rules 44 and 45 thereof;

CONSIDERING the Directive on Assignment of Defence Counsel ("the Directive"), as subsequently amended in particular Article 7, Article 14, and Article 16 thereof;

CONSIDERING that on 30 July 2003, the Registrar issued a decision assigning Mr. Nicholas Stewart, attorney at law from London, as lead counsel to Mr. Momcilo Krajisnik ("the accused"), and withdrawing Mr. Goran Neskovic, attorney at law from Doboj, as co-counsel to the accused;

CONSIDERING that on 15 August 2003, Mr. Stewart requested the Registrar to assign Ms. Chrissa Loukas, attorney at law from New South Wales, to the accused as co-counsel;

CONSIDERING that in accordance with Article 16 (C) of the Directive, at the request of lead counsel, the Registrar may assign a second counsel to assist the lead counsel if it is in the interests of justice to do so;

CONISIDERING that Ms. Loukas is a member of the Association of Defence Counsel and complies with the requirements to be added to the Rule 45 (B) list of counsel who are eligible to be considered for assignment of counsel;

CONSIDERING that the assignment of a co-counsel at this stage of proceedings would facilitate the expeditious preparation of the case and is thus consistent with the rights of the accused;

HEREBY DECIDES to assign Ms. Chrissa Loukas, attorney at law from New South Wales, as co-counsel to the accused, effective as of the date of this decision.
