THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,

NOTING the "Prosecution’s Motion for Admission of Additional Evidence," filed partly confidentially and with an ex parte annex on 11 November 2003, in which the Prosecution seeks to present, as additional evidence under Rule 115 of the Rules of Procedure and Evidence of the Tribunal, the evidence given by Mr. Miroslav Deronjic in the case of Prosecutor v. Nikolic, No. IT-02-60/1-S;

NOTING the Defence "Response to Prosecution’s 11 November 2003 Motion for Admission of Additional Evidence," filed confidentially on 17 November 2003;

NOTING the "Prosecution’s Reply Regarding the Prosecution’s Motion of 11 November 03 to Admit Additional Evidence," filed partly confidentially on 18 November 2003;

CONSIDERING that the Motion does not comply with the time limit prescribed by Rule 115, and that the Prosecution failed to show good cause for delay;

HEREBY DISMISSES the Motion.
