PROSECUTOR

v.

DRAGOLJUB KUNARAC
RADOMIR KOVAC
and
ZORAN VUKOVIC

_______________________________________________________________________________

ORDER ON RULE 90(E)

_______________________________________________________________________________

Office of the Prosecutor:

Mr. Dirk Ryneveld

Counsel for the Accused:

Mr. Slavisa Prodanovic for the accused Dragoljub Kunarac
Mr. Momir Kolesar for the accused Radomir Kovac
Mr. Goran Jovanovic for the accused Zoran Vukovic

1. The Trial Chamber is seised of the "Prosecutor’s Motion Pursuant to Rule 90(E)" ("Motion"), which was filed on 8 March 2000. The Prosecutor requests the Trial Chamber to issue an order authorising Ms. Tejshree Thapa, a Research Officer with the Prosecutor who effectively functioned as the Prosecutor’s lead investigator in this case, to be present during the trial proceedings and directing that she shall not, on that basis, be precluded from being called as a witness. The Defence filed a joint confidential "Defence Response to the Prosecutor’s Motion Pursuant to Rule 90(E)" ("Response") on 14 March 2000. The Defence does not oppose the Motion.

2. The Trial Chamber has considered the Motion and the Response thereto, and, pursuant to Rule 90(E) of the Rules, decides to grant the Motion, with the proviso that, depending on the circumstances, the fact that Ms. Thapa has been in court may be relevant to the weight given to any evidence she may later give.

3. The Trial Chamber hereby grants the Motion.

Done in both English and French, the English version being authoritative.
