THE TRIAL CHAMBER, proprio motu,

NOTING the continuation of the initial appearance of the accused, Dragoljub Kunarac, scheduled for 4.30 p.m. on 10 March 1998,

NOTING that counsel for the accused, Mr. Slavisa Prodanovic, failed to attend today’s hearing without leave of the Trial Chamber

NOTING the memorandum from the Deputy Registrar of 10 March 1998 informing the Trial Chamber of the absence of Mr. Slavisa Prodanovic, explaining the circumstances as put forward by counsel for the accused and stating that Mr. Slavisa Prodanovic had already left The Hague,

NOTING with grave concern that counsel for the accused had not consulted with his client before embarking on this course of action,

PURSUANT TO Rules 54 and 77 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY

RESCHEDULES the continuation of the initial appearance to 8.30 a.m. on Friday 13 March 1998; and

ORDERS Mr. Slavisa Prodanovic to appear before the Trial Chamber at that time, having made adequate provision for prior consultation with his client, and to explain to the Trial Chamber the circumstances of his absence from today’s hearing, failing which the Trial Chamber will consider instituting proceedings for contempt.
