TRIAL CHAMBER II of the International Criminal Tribunal for the Former Yugoslavia;

BEING SEISED of the request of Trial Chamber III of 10 May 1999 for the release of the trial transcript regarding the testimony of witness CD in the hearing of 7 May 1999 in case IT-95-16-T;

CONSIDERING the orders and decisions of this Chamber granting protective measures to the witness in this case, i.e. the witness testifying in private session;

CONSIDERING THAT witnesses, once they have taken the Solemn Declaration pursuant to Rule 90 (B) of the Rules of Procedure and Evidence, become witnesses of truth before the Tribunal and are not strictly witnesses for either Party;

CONSIDERING the Trial Chamber’s ongoing duty to protect its witnesses;

NOTING that according to the information furnished to the Chamber today by the Victims and Witness Section, witness CD has no objection to the transcript of his testimony of 7 May 1999 being released to Trial Chamber III

PURSUANT TO Rule 54 and Rule 75 of the Rules of Procedure and Evidence of the Tribunal

HEREBY RELEASES

the redacted transcript of the private-session testimony of witness CD to Trial Chamber III.

Done in English and French, the English text being authoritative.
