TRIAL CHAMBER I ("the Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");

PURSUANT to Rule 75 (D) of the Rules of Procedure and Evidence;

NOTING the "Prosecution’s Motion Pursuant to Rule 75 (D) to Lift Confidentiality of Expert Report" (hereby "the Prosecution’ Motion") filed on 2 November 2001;

Noting that the Expert Report was filed as "Submission of Expert Statement of Dr. Robert J. Donia" on 30 March 2001 then admitted as Prosecutor exhibit 3/266 (hereinafter "Expert Report");

NOTING that on 27 April 2001 a joint motion of the Prosecution and of the Defence for Mlado Radic for "Admission into Evidence of Expert Statements of Professor Nenad Kecmanovic and Dr. Robert Donia" was filed;

NOTING that Dr. Donia was consulted by the Prosecution on the possibility of making the Expert Report public;

ORDER that the confidentiality of the Expert Report be lifted.
