TRIAL CHAMBER I ("the Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal"),

PURSUANT to Article 20 and 21 of the Statute, and to Rule 65 of the Rules of Procedure and Evidence of the Tribunal;

BEING SEIZED of the "Defence Motion for Provisional Release of the Accused", filed on 15 April 2002 ("the Motion"),

NOTING the Prosecutor’s "Request for Extension of Time in Which to File Response to Application for Provisional Release", filed on 26 April 2002;

NOTING the "Decision on the Prosecution Request for Extension of Time in Which to File Response to Application for Provisional Release", of 29 April 2002;

NOTING the "Prosecution’s Response to the Application for Provisional Release" and Annexes, filed on 17 May 2002 ("the Response"), in which the Prosecution opposes the Motion;

NOTING the "Defence Reply to the Prosecutor’s Response to Application for the Provisional Release", filed on 23 May 2002;

BEING SEIZED of the "Defence Motion Requesting the Hearing of the Representative of the Government of the Republic of Croatia in Order to Decide on the Motion for Provisional Release", of 29 May 2002, in which the Defence requests that the Trial Chamber hear a representative of the Government of the Republic of Croatia in relation to the guarantees offered by this country;

ORDERS as follows:

STATES that, pursuant to Rule 65 ter (B), an authorised representative of the Republic of Croatia may appear before the Trial Chamber; and that this representative shall participate in the hearing as and when deemed appropriate by the Trial Chamber.
