THE TRIAL CHAMBER,

NOTING the Order issued by the Trial Chamber on 2 June 1998 setting the further appearance of the accused for Friday 12 June 1998 at 2 p.m,

NOTING the Defence Motion To Continue The Date For Additional Appearance Of The Accused filed on 5 June 1998,

NOTING FURTHER THAT the Defence has indicated that it is ready to proceed to trial on 6 July 1998 on the counts of the originally confirmed and the amended indictments,

NOTING THAT the Office of the Prosecutor ("Prosecution") has also indicated its readiness to proceed on 6 July 1998,

NOTING FURTHER that Defence counsel should not be prevented from preparing for the trial by being required to attend at the seat of the International Tribunal unless absolutely necessary,

CONSIDERING THAT, in light of the Defence indication of readiness to proceed, it is not necessary to postpone the date for trial on the amended indictment,

PURSUANT TO RULES 50 and 54 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules")

HEREBY ORDERS as follows:

  1. the date of Friday 12 June 1998 for the further appearance of the accused to plead to the new charges in the amended indictment is hereby vacated and rescheduled to Monday 6 July 1998 at 9.30 a.m; 
  2. the trial will commence on 6 July 1998 as scheduled, following the further appearance;
  3. any Defence preliminary motions to be filed pursuant to Rules 50 (C) and 72 shall be filed by Monday 29 June 1998 so as to enable the Prosecution to respond before the commencement of trial;
  4. the Prosecution shall file a further pre-trial brief on points in the amended indictment other than genocide and complicity in genocide by Tuesday 16 June 1998;
  5. the Defence shall have leave to respond to the pre-trial brief as soon as practicable thereafter and, in any event, prior to the commencement of trial.
