 6             THE REGISTRAR:  Good morning, Your Honours.

 7             This is the case IT-09-92-T, the Prosecutor versus Ratko Mladic.

 8             JUDGE ORIE:  Yes, thank you.  Good morning to everyone.

 9             The Chamber was informed there are two preliminaries to be

10     raised.  Defence first.

11             Mr. Stojanovic, is it about D394?

12             MR. STOJANOVIC: [Interpretation] That's correct, Your Honours,

13     yes.

14             [Indiscernible] to the understanding of our dear Janet, we have

15     the video-clip prepared as an exhibit.  It is D394, as you have rightly

16     said.

17             JUDGE ORIE:  Yes.  That number was reserved.  It had not been

18     uploaded at that time.

19             No objections from the Prosecution.  If not, D394 is admitted

20     into evidence.

23             MR. GROOME:  Good morning, Your Honours.

24             On the 22nd of May, 2013, the Prosecution filed a 92 bis motion

25     for RM038.  A decision on that matter is still pending.  Due to some

 1     recent developments in the region, namely, the exhumation at the Tomasica

 2     mine the Prosecution is considering whether it might be more appropriate

 3     to call or tender this witness's evidence pursuant to 92 ter.  I'm

 4     sending some staff to the region to further investigate some developments

 5     and I'm asking until next week to notify the Chamber whether we will

 6     maintain our 92 bis application or seek conversion to 92 ter.

 7             JUDGE ORIE:  Yes, to the extent we were about to give a decision

 8     on it, we will put it on hold for the time being.

 9             MR. GROOME:  Thank you.

10             JUDGE ORIE:  Nothing else.

11             Is the Prosecution ready to call its next witness, whose

12     testimony will be heard in closed session.

13             Mr. Shin.

14             MR. SHIN:  Good morning, Mr. President, Your Honours, counsel,

15     and everyone in the courtroom.

17     be in closed session.

 1     would focus on what seems to be the core of the testimony of the witness

 2     rather than to extensively deal with matters that seem more in the margin

 3     of what the witness testifies about.

 4             Would you please consider that overnight and try to reduce the

 5     time you'd still need.

 6             We adjourn for the day, and we will resume tomorrow, Friday, the

 7     1st of November, 2013, in this same courtroom, I.  But I already can

 8     announce that it is expected that we would continue to hear testimony in

 9     closed session tomorrow.
