TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):
BEING SEISED OF the "Motion of Mr. Radic’s Defence Requesting Postponement of Issuing a Decision on the Motion for Provisional Release Filed on 19 June 2003" ("Motion"), filed confidentially and on an ex parte basis by Defence Counsel for the Accused Miroslav Radic (“Radic”);
NOTING that, in the Motion, Radic requests that the Trial Chamber postpone its decision on his application for provisional release, filed on 18 June 2003,1 until such time as the Office of the Prosecutor seeks leave to file a consolidated amended indictment against Radic, Mile Mrksic and Veselin Sljivancanin and all preliminary motions pursuant to Rule 72 of the Rules of Procedure and Evidence ("Rules"), should there be any, are thereafter disposed of; 2
CONSIDERING that the Trial Chamber finds the arguments put forward by Radic persuasive;
FOR THE FOREGOING REASONS
PURSUANT TO Rule 54 of the Rules;
HEREBY GRANTS the Motion.
