TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"),

BEING SEISED of the "Request for the Review of the Registrar’s Decision of January 30, 2004", filed on 13 February 2004 ("Motion") by the Defence Counsel for the Accused Veselin Sljivancanin ("Sljivancanin"), requesting the Trial Chamber to review the Decision of the Deputy Registrar of the Tribunal ("Deputy Registrar") dated 30 January 2004 ("Registry Decision"1);

NOTING that the Registry Decision determines that Sljivancanin should bear the costs of 202 hours of investigative and legal support work performed during the pre-trial stage of the proceedings, and that these hours shall be deducted from the allotment of hours provided by the Registry for support staff work under the current legal aid payment system of the Tribunal;2

NOTING that Sljivancanin argues in the Motion that:

  1. the Deputy Registrar did not examine all the relevant information and did not provide all the relevant reasons to reach a just and correct decision;3
  2. the Registry Decision is unclear as to the total amount of hours allotted by the Registry to the Defence for this case;4

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the Tribunal;

HEREBY DIRECTS the Deputy Registrar, by 20 April 2004, to:

  1. file (i) copies of any material upon which the Deputy Registrar based the Registry Decision; and (ii) comments on the Motion (collectively "Registry Submission"); and
  2. clarify the total number of hours allotted by the Registry to Sljivancanin for the pre-trial stage of the case Prosecutor v. Mile Mrksic, Miroslav Radic, Veselin Sljivancanin;

AND ORDERS Sljivancanin to subsequently file comments by 4 May 2004 on the Registry Submission, with specific reference as to how the Deputy Registrar may have failed to comply with the legal requirements governing the Registry Decision.
