I, Mohamed Shahabuddeeen, a Judge of the Appeals Chamber of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991("the International Tribunal"),

NOTING the Judgement pronounced by the Appeals Chamber in the trial of Hazim Delic on 20 February 2001;

NOTING that the Appeals Chamber is seised of "Hazim Delic’s Motion for the Review of Proceedings", filed confidentially by counsel for Hazim Delic on 15 January 2002;

NOTING that Article 20(1) of the Statute of the International Tribunal establishes the right to a "fair and expeditious" trial;

NOTING that, pursuant to Rule 22 (B) of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"), I have been elected as Presiding Judge of the Appeals Chamber in this matter;

NOTING that Rule 65ter of the Rules, read together with Rule 107 of the Rules, authorises the Presiding Judge of the Appeals Chamber to designate a member of the Appeals Chamber to be responsible for pre-appeal proceedings;

CONSIDERING that to designate a Judge ("the Pre-Review Judge") vested with the power to address problems arising during review proceedings on behalf of the Appeals Chamber is in the interests of the proper administration of justice and the expeditiousness of the proceedings;

CONSIDERING that the Pre-Review Judge will have power to: (i) take decisions on procedural motions; (ii) transmit motions to the Appeals Chamber as he sees fit; and (iii) hold one or several status conferences, if need be.

HEREBY DESIGNATE, with immediate effect, Judge David Hunt as Pre-Review Judge.
