THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a "Defence Motion for Clarification Matters in regard of Amended Attachment ‘A’" filed by counsel for the accused Damir Dosen on 20 November 2000 ("Motion"),

NOTING the confidential and ex parte "Prosecutor’s Response to the Accused Dosen’s Defence Motion for Clarification Matters in regard of Amended Attachment ‘A’" filed on 22 November 2000 ("Response"), wherein certain amendments were proposed by the Office of the Prosecutor ("Prosecution") in order to clarify the Amended Attachment A filed on 29 September 2000 and to correct a typographical error in paragraph 39 of the Amended Indictment filed on 9 September 1999 and,

HAVING HEARD the parties in respect of this matter at a status conference held on 22 November 2000,

NOTING that, at the status conference, counsel for the accused Damir Dosen, following prior discussions with the Prosecution, expressly agreed to the amendments proposed by the Prosecution in the Response in respect of both the Amended Indictment and Amended Attachment A,

CONSIDERING that it is in the interests of justice to permit the amendments contained in the Response, which are consistent with the requirement laid down by the Scheduling Order issued and filed by this Chamber on 22 September 2000, that "SnCo changes to the details provided in respect of the other two accused Si.e. Dosen and KolundzijaC are permitted, other than to conform the numbering of the counts to those in the amended Indictment of 24 August 1999",

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal and

WITH THE AGREEMENT OF THE PARTIES

HEREBY ALLOWS the amendments proposed in the Response and ORDERS the Prosecution by Friday 5 January 2001 to file a final version of the Amended Indictment and of the Amended Attachment A, incorporating the amendments contained in the Response.
