I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("the International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an order of the Trial Chamber dated 3 February 2000,

BEING SEISED of a "Prosecution’s Motion for Extension of Time to Comply with the Trial Chamber’s Decision on Defence Motion to Compel Discovery’" ("the Motion"), filed on 17 May 2000 by the Office of the Prosecutor ("Prosecution") seeking an extension of time, from 18 May 2000 to 5 June 2000, in which to disclose to the Defence for each accused an unredacted copy of the document entitled "Extracts of Evidence", as ordered by the Trial Chamber on 11 May 2000,

NOTING that the Prosecution acknowledges that certain of the witnesses named in the "Extracts of Evidence" do not request protective measures,

NOTING the status conference scheduled in this matter on Wednesday 7 June 2000,

CONSIDERING that the reasons given in support of the Request constitute good cause for the purpose of Rule 127 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"),

PURSUANT TO Rule 127 of the Rules,

HEREBY GRANT the Motion in part and ORDER as follows:

  1. the Prosecution shall immediately disclose to the Defence for both accused the names of the six witnesses who have confirmed that they do not request protective measures; and
  2. the Prosecution shall have until Thursday 1 June 2000 to disclose to the Defence for each accused an unredacted copy of the "Extracts of Evidence" or to file a motion for specific protective measures for individual witnesses.
