I, FAUSTO POCAR, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("International Tribunal"),

NOTING the “Appellant Blagoje Simic’s Notice of Appeal" filed on 17 November 2003, against the Judgement rendered by Trial Chamber II on 17 October 2003 and filed on 29 October 2003;

NOTING the "Order Replacing a Judge in a Case Before the Appeals Chamber", filed on 15 July 2005, which ordered that as of 15 August 2005, the Appeals Chamber in the present case shall be constituted as follows:
