DECISION ON THE APPLICATION OF THE ACCUSED MR. MILAN SIMIC TO LEAVE HIS RESIDENCE FOR MEDICAL REASONS

The TRIAL CHAMBER,

NOTING the application filed by the accused, Milan Simic, on 8 April 1998, requesting authorisation to leave the municipality of Bosanski Samac for medical reasons (hereinafter "the Application"),

NOTING the decision of 26 March 1998 granting the provisional release of the accused, decision also ordering court supervision,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence,

CONSIDERING that the Defence refers to the deteriorating medical condition of the accused in support of its Application, including the appearance of a further ailment (open wounds on both heels) requiring appropriate treatment not available in the municipality of Bosanski Samac but which is in fact available at the Military Medical Academy Center in Belgrade,

CONSIDERING that the medical certificate produced at our request subsequent to filing the Application specifies that a stay of 7 days in Belgrade is necessary for a complete examination of this new ailment,

CONSIDERING that the strict court supervision to which the accused is subject should not result in depriving him of care indispensible to his health,

CONSIDERING that the Prosecutor indicated that she did not object to the accused’s being in Belgrade for medical reasons,

FOR THE FOREGOING REASONS

AUTHORISES, exceptionally, the accused to leave the municipality of Bosanski Samac to undergo treatment in Belgrade at the Military Medical Academy Center for the time strictly required to treat the alleged ailment, that is, fifteen days from the date of this Decision,

ORDERS the Defence to produce at the end of said period a detailed medical certificate so that the Trial Chamber may assess the medical condition of the accused,
