THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

HAVING issued an Order on 4 September 2003 concerning the testimony of Lord Owen as a witness of the Trial Chamber pursuant to Rule 98 of the Rules of Procedure and Evidence of the International Tribunal ("Rules"), and the provision of a statement by him in advance of his testimony ("Order"),

NOTING the statement and annexes submitted by Lord Owen ("the Witness") in accordance with the Order and filed on 9 October 2003,

CONSIDERING that it would be beneficial to set a timetable for the examination of the Witness by the parties,

NOTING the submissions of the parties in an oral hearing on 16 October 2003 concerning the time they would like for cross-examination,

PURSUANT TO Rules 54 and 98 of the Rules

HEREBY ORDERS as follows:

  1. the Witness may make a brief statement if he so chooses at the commencement of his testimony;
  2. the Prosecution shall then be entitled to cross-examine the Witness for a period of two hours;
  3. the Accused, on conclusion of the Prosecution’s questioning, shall be entitled to cross-examine the Witness for a period of three hours;
  4. the amici curiae shall thereafter be entitled to cross-examine the Witness for a period of 30 minutes; and
  5. the Trial Chamber may ask questions of the Witness as and when appropriate.
