THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
NOTING that the "Confidential and Ex Parte Notice by Assigned Counsel of Witness Developments Pursuant to Order of Trial Chamber of 1 October 2004", filed by the Defence on 8 October 2004 on a confidential and ex parte (of the Prosecution) basis (Notice"),
NOTING that, during the hearing held on 13 October 2004,1 the Defence stated that no protected witnesses were contained in the Notice and agreed to the lifting of the ex parte status of the Notice with respect to the Prosecution,
PURSUANT to Rule 54 of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY ORDERS that the Registry shall change the status of the Notice from confidential and ex parte to confidential and shall serve a copy of the Notice on the Prosecution.
