THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 (“Tribunal”) is seized of a “Prosecution Application For An Order Pursuant To Rule 54bis Directing Serbia And Montenegro To Comply With Outstanding Requests For Assistance” and a “Prosecution Second Motion For Further Action In Relation To Previous Rule 54bis Applications” and hereby renders a preliminary order thereon.

1. On 9 December 2005 the Prosecution filed a motion for an order pursuant to Rule 54 bis directing Serbia and Montenegro to comply with outstanding Requests For Assistance (“9 December Motion”) and on 12 December 2005 the Prosecution filed a motion seeking further action from the Chamber in relation to previous Rule 54 bis applications (12 December Motion) (together, “the Motions”).

2. Pursuant to Rule 54 of the Rules, the Trial Chamber hereby:

(a) ORDERS Serbia and Montenegro to file its response to the Motions by 23 December 2005, and
(b) INVITES Serbia and Montenegro to produce forthwith to the Prosecution any documents that are responsive to the Motions and are available to it.
