THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
BEING SEISED of a "Prosecution’s Application for an Order Pursuant to Rule 54 bis Directing the Federal Republic of Yugoslavia to Produce Documents", filed by the Office of the Prosecutor ("Prosecution") on 12 July 2002 ("the Application"), requesting the issue of an Order requiring the Federal Republic of Yugoslavia to produce various documents held by the District Court in Belgrade, including but not limited to, specifically, Complaint of the Accused Slobodan Milosevic, Decision on Arrest dated 2 April 2001 and the Court Decision on the same complaint dated 3 April 2001,
NOTING the Scheduling Order issued by the Trial Chamber on 26 July 2002 fixing a hearing on the Application for Monday 16 September 2002,
NOTING the "Notice Regarding Prosecution Application Pursuant to Rule 54 bis dated 12 July 2002" filed by the Prosecution on 12 September 2002 in which the Prosecution notifies the Trial Chamber that the Prosecution wishes to try to resolve the matter by direct negotiation with the relevant authorities and requests that the hearing scheduled for 16 September 2002 be vacated and the Application suspended pending further report,
PURSUANT to Rules 54 and 54 bis of the Rules of Procedure and Evidence of the International Tribunal
HEREBY VACATES the hearing scheduled for 16 September 2002 and ORDERS the Prosecution to file a report with the Trial Chamber on the status of this matter no later than Friday 11 October 2002.
