I, Wolfgang Schomburg, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

HAVING BEEN DESIGNATED pre-trial Judge in the present matter by the "Order Appointing a Pre-Trial Judge" issued by Trial Chamber II of the International Tribunal on 28 November 2001,

BEING SEIZED OF the "Prosecution’s Motion for Extension of Time to File its Final Pre-Trial Brief and Rule 65ter Submissions" filed by the Office of the Prosecutor ("Prosecution") on 14 January 2002 ("Motion"), wherein the Prosecution seeks an extension of time till sometime closer to the commencement of trial in the present proceedings, in respect of the filing of the final version of its pre-trial brief and certain submissions pursuant to Rule 65ter of the Rules of Procedure and Evidence of the International Tribunal ("Rules"), which is currently due on 16 January 2002;

NOTING that the Motion relies for justification on the claimed nexus between the present case and the case of Prosecutor v. Brdjanin and Talic, the trial in the latter commencing 21 January 2002;

CONSIDERING the exchanges between the parties made during a meeting held on 8 January 2002 pursuant to Rule 65ter of the Rules;

RECALLING the "Decision on Prosecution’s Motion for a Joint Hearing" issued by this Trial Chamber on 11 January 2002 which denies the Prosecution request for a joint hearing of a portion of evidence allegedly common to both the present case and Prosecutor v. Brdjanin and Talic;

CONSIDERING that the Motion has not shown good cause to justify the extension of time at this stage of the proceedings;

PURSUANT TO Rule 65ter of the Rules,

HEREBY DENY the Motion.
