This Trial Chamber of the International Criminal Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991;

Noting that the sentencing hearing in this matter has been scheduled to be held on Friday, 15 October 1999, commencing at 10.00 a.m.;

FURTHER NOTING that the Defence has requested that a report be prepared by the United Nations Detention Unit on the behaviour of the Accused during the time he has spent in custody hitherto;

AND NOTING that the Defence has on 10 October 1999 filed a motion for leave to file the "Appellant’s Reply to Cross-Appellant’s Assessment of Material Provided by Appellant on 19th April 1999 as a Confidential Annex to Defendant’s Brief on Sentence Dated 29th September 1999" ("Motion"), said material being in the possession of the Prosecutor;

CONSIDERING that the Trial Chamber considers it desirable to have the report prepared by the Detention Unit in order to assist the Chamber when deliberating on the sentence, and that the Trial Chamber has to form an independent view of the nature of the material referred to in the Accused’s Motion;

HEREBY

REQUESTS the Registrar to have the report prepared and filed with the Trial Chamber not later then 4.00 p.m. on Thursday, 14 October 1999; and

FURTHER REQUESTS the Prosecutor to file confidentially the material mentioned in the Motion referred to herein with the Trial Chamber not later then 4.00 p.m. on Thursday, 14 October 1999.
