I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 (“Tribunal”);
NOTING the Indictment in the case The Prosecutor v. Zdravko Tolimir, Radivoje Miletic and Milan Gvero, confirmed by Judge Daqun Liu on 10 February 2005;
NOTING the two Decisions by Judge Daqun Liu dated 23 February 2005 and 25 February 2005 lifting the confidentiality of the Indictment against Radivoje Miletic and Milan Gvero and subsequently against Zdravko Tolimir;
NOTING that Radivoje Miletic and Milan Gvero (“Accused”) surrendered and were transferred to the seat of the Tribunal on 28 and 24 February 2005 respectively;
NOTING the Order by the President of the Tribunal dated 24 February 2005 and the Order of the Vice-President of the Tribunal dated 28 February 2005, both assigning the case against Radivoje Miletic and Milan Gvero to Trial Chamber II;
PURSUANT TO Rule 64 of the Rules of Procedure and Evidence of the Tribunal;
HEREBY ORDER the detention on remand of the two Accused
and enjoin the Commanding Officer of the United Nations Detention
Unit in The Hague to detain the two Accused until further order.
